Providing safety data to the customs of the European Union
This was stated in a tweet via Twitter issued this morning on the website of the European Union Mission to the Arab Gulf States, which is based in Riyadh. Through the European Union, one of them states, “Operators are required to complete an ENS data set for all cargo in air transport.
All goods transported by air in postal, express and general cargo consignments, in addition to deposit pre-loading requirements, will be subject to completion of ENS data requirements prior to arrival.
It is reported that the new data requirements entered into force on March 1, 2023, with the release of version 2 of ICS2, as provided for in Appendix B of the Federal Customs Law Implementation and Authorization Law •••. Advertisers should pay particular attention to some of the new data requirements. Notably, they will have a legal obligation to provide ENS details:
HS commodity code (6 digits) for goods of a commercial nature (such as B2B and B2C): Combined designation EN •••
The EORI of the consignee generated in the European Union, if that number is assigned to that party. The parties need to make their EORI number available to the ENS Advertiser. The EORI number can be validated on the following web service of the European Union Commission, to ensure that the data is correct: EOS What's New (europa.eu) EN •••.
Appropriate descriptions of the goods, in language that is clear and accurate enough for the customs authorities to be able to identify the goods, are also very important. Please refer to the “Guidelines for descriptions of unacceptable goods” available in the Import Control Regime 2 - Version 1 (europa.eu) EN •••.
It is therefore very important for advertisers to ensure that they get all the required information from their customers.
EU customs authorities may reject ENS declarations in the absence of complete data or issue risk mitigation referrals at the pre-arrival stage asking the declarant to provide the necessary data, for example where the data is inaccurate. This can lead to delays in ENS processing when shipments arrive and in the entry process, as referrals that mitigate risks must be responded to and required information must be provided before the risk assessment can be resumed. Customs may also decide to impose administrative penalties for non-compliance with data requirements.
