The Council of the European Union today adopted the General Product Safety Regulation (GPSR), which strengthens safety rules for products sold offline and online. The regulation will strengthen market surveillance for unsafe products and the consumer rights of anyone who has been sold an unsafe product.
“Through approved regulations, we are making sure consumers have the highest level of product security, whether they are shopping online or physically. If we are serious about digital transformation, we need to ensure that citizens feel confident about the safety of what they buy independent of how they buy.” .
According to what was stated in a European statement issued in Brussels, quoting Eric Slutner, Swedish Minister of Public Administration, whose country currently holds the rotating presidency of the European Union. The statement also stated, "The regulation adopted today enhances product safety and consumer protection, and makes it easier for consumers to repair, return or replace unsafe products." In detail:
Online marketplaces will have to cooperate with market monitoring authorities if they detect a dangerous product on their platform, and should establish a single point of contact responsible for product safety.
Market surveillance authorities will be able to order online markets to remove dangerous products from their platforms or disable their access
A single market control system will be applied to all products
If a product proves to be unsafe, economic operators must immediately adopt corrective measures and inform the market and consumer control authorities
If a product must be recalled, consumers have the right to either have it repaired, replaced, or refunded (and can choose between at least two of these options).
Economic operators must have a person responsible for products sold online and offline (regardless of the origin of the product), who will ensure the availability of technical documentation, instructions and safety information
